* Safety- Marijuana is far safer than many, many chemical drugs prescribed legally. I chose to use marijuana for a variety of ailments, because of marijuana's safety.

Signs Laws Increasing Drug Penalties

On August 4, New Jersey Governor Christine Todd Whitman (R) signed three bills that will stiffen sentencing for drug offenses and make it easier for prosecutors to seize the property of convicted drug dealers ("Whitman Signs Drug Laws," The New York Times, August 5, 1997, p. B1; Roya Rafei, "Whitman OKs Tough Anti-Drug Laws," Herald & News, August 5, 1997, p. B1; Ron Marisco, "Hopefuls warm up for gubernatorial bid," Star Ledger (Newark), August 5, 1997, p. 19).

The Governor, facing a tough re-election challenge in November, signed the two bills into law at the Passaic County jail. One measure (A-2957) increases penalties for those who carry large amounts of marijuana and methamphetamine, making it a first-degree crime to manufacture, distribute or dispense 25 pounds or more of marijuana, 50 or more marijuana plants, 5 or more pounds of hashish, or more than 5 ounces of methamphetamine. The second measure (A-2958) allows the state to forfeit property of drug defendant even if the property cannot be traced to illegal activity. A third measure (A-2956) increases penalties for drug dealers who employ booby traps or other impediments to harm law enforcement.

On August 8, Whitman signed legislation (A-2725) allowing for a 20-year prison sentence for a rape conviction if the victim is incapacitated by a so-called "date rape drug," such as Rohypnol®, or gamma hydroxybutyrate (GHB). GHB has been unregulated but is described by Andrew Weil, MD, as an "endogenous downer." It is also used by body builders because of its effect on the pituitary gland. GHB can produce intoxication (Andrew Weil, MD, From Chocolate to Morphine, Rev'd Ed., 1993, p. 77).

The new law also makes possession of Rohypnol® or GHB an offense punishable by up to five years in prison and a $100,000 fine. Rohypnol® has been reported on by NewsBriefs extensively (See "Florida Lawmakers Try to Crack Down on 'Raves,' and Associated Drugs," NewsBriefs, May-June 1997; "Clinton Signs Legislation Increasing Penalties for Methamphetamine and Rohypnol®," NewsBriefs, November 1996). On the same day, Whitman also signed a bill (A-2712) that designates Ketamine, an anesthetic, known as "Special K," as a controlled dangerous substance. Andrew Weil, MD, describes Ketamine as a close relative of PCP, but notes that it is often diverted from medical supplies (Weil, p. 139). "Three men arrested on Marijuana Charges"

Bellmawr - Authorities closed in Monday on three South Jersey men accused of having 45 pounds of marijuana shipped to Bellmawr from Arizona.

Self-employed truck driver ROBERT EDWARD FORCHION, Jr. 33 of the 500 block of Seigfried Avenue Chesilhurst and Russell Forchion, 28 of Union Street Glassboro, were arrested Monday along Route 42 in Bellmawr authorities said. Police and members of the Camden County Prosecutors Office "Narcotics Unit reportedly seized 45 pounds of marijuana from a vehicle in which the men were riding. The two are related but authorities did not dis-close how.

A third man, ERIC POOLE, 39, of the fountainveiw Apartments, Blackwood was arrested almost simultaneously at an undisclosed business near the Bellmawr Industrial Park. The arrests were the culmination of a month long investigation into the group’s activities by Police in Bellmawr and Phoenix, Arizona and a federal and state drug task force.

Authorities allege Robert Edward Forchion went to Phoenix, where he also has a residence, to arrange for the shipment of marijuana to a Bellmawr business. The name of the business was not disclosed.

All three men arrested Monday have been charged with possession with intent to distribute more than 25 pounds of marijuana and related drug charges, said GREG REINHART, spokesman for the Camden County Prosecutors Office.

Robert Forchion was being held Monday at the Camden County Jail on $100,000 cash bail. Russell Forchion was being held at the same facility on $75,000 cash bail. While authorities said, drug charges are pending, Poole was being held at the same jail on municipal charges.

The Forchion’s and Poole are the first individuals charged with distribution of more than 25 pounds of marijuana in Camden County since Gov. Christie Whitman made the offense a first degree crime in August.

If convicted of the charge they each face up to 20 years in prison and $300,000 in fines.

THAT’S HOW IT ALL STARTED!

AFTER I WAS ARRESTED I DECIDED I WAS GONNA FIGHT THE STATE CHARGES WITH A OPEN ADVOCATION OF JURY NULLIFICATION AS A DEFENSE.

As “MIRANDA” say’s, “anything you say and do can and will be used against you at time of trial”.  My reasoning then was it can also be used for you. This was my plan: (1)-To run for political office under the (LMP) - Legalize Marijuana Party, (2)-stage acts of civil dis-obedience and (3)-make numerous statements that would all be introduced at my trial. (5) Openly advocate to members of my jury to utilize JURY NULLIFICATION. Encourage at least one member of my jury to openly feel as I do and vote their conscience with a vote of acquittal. I called my defense: “ OPEN ADVOCATION OF JURY NULLIFICATION” or the “WEEDMAN DEFENSE”. 

Think about it, I only need to convince one juror!

Sometime soon, a man named Ed Forchion will go to trial in New Jersey, charged with Conspiracy and possession of over 40 pounds of marijuana. Forchion, a former truck driver turned medical marijuana supplier and a practicing Rastafarian, faces up to 30 years in prison as a conscientious objector in the War on (some) Drugs; even so, he'll act as his own defense counsel. The Camden County Public Defender's Office refused to defend Mr. Forchion because of his planned defenses -Religion, Medical, and Open avocation of Jury Nullification. For most people, this would be quite a challenge, but Forchion's defense is simple: He says that the government has no business telling people what they can put into their own bodies and wants the jury to refuse to enforce the law.

Mr. Forchion was arrested on Nov. 24th, 1997. He denies being in possession of any amount of marijuana on that day. The State of New Jersey is trying to exploit the Conspiracy laws. Mr. Forchion say's the charges were an attempt to force him to cooperate with authorities into revealing source's and users. Mr. Forchion was well entrenched in black-market controlled medical distribution of Marijuana in Southern New Jersey. ("What other options do we have, we can't get it from the store, our properties are taken if we grow it ourselves") Mr. Forchion is a medical user of marijuana and a follower of RASTAFARI. Mr. Forchion has supported marijuana legalization causes for years. Mr. Forchion has entered a not-guilty plea, and openly state's he has every right to use marijuana.

 

 

 

RASTAFARI is an African based Religion, with strong roots to Jamaica. Some 700,000 Americans now practice RASTAFARI. Some 40 Million-world wide. It is among the 1,558 religious groups sufficiently stable and distinctive to be identified as one of the existing religions in this country. Why doesn’t the first amendment apply to religions such as Mr. Forchion's, it's a combination of Racism and Christian Religious Persecution says "RAS ED" as his followers call him.

 

In the RASTAFARIAN religion the "herb" (marijuana) or "GANJA" is considered a sacrament and most Rasta's use daily, for spirituality and medical use. The present Marijuana laws are absolutely unconstitutional, for its failure to make exceptions for religious or religiously required self medicating purposes in this Marijuana Prohibition (1937-present) as was done with alcohol during the alcohol prohibition. Christians/Catholic were able to continue to use alcohol (wine) during the course of alcohol prohibition under the cloak of the 1st Amendment. Native Americans are protected from prosecution for the use of Peyote, which the rest of are forbidden from using. (Native American Peyote act). Even follower's of Sanatoria, are protected from animal cruelty laws by the first amendment which protects their chicken/religious sacrifices.

 

Mr. Forchion is challenging the Constitutionality of the New Law which he was indicted under, on the grounds that it violates his Religious Freedom. He has chosen to take his challenge to the Jury. In an unprecedented open avocation of Jury Nullification as a defense. This case has the potential to be of national importance both for it's legality of marijuana through "Religious Freedom" and the Jury Nullification issue.

Ed, on Nov.24, 1997 was the first person arrested and charged under a NEW LAW signed by Governor Whitman on August 3, 1997. Knowing all NEW LAWS are subject to constitutional challenge's Mr. Forchion has chosen to defend himself with an "Open Avocation of Jury Nullification", as a defense. He has chosen to challenge the constitutionality of this NEW LAW with a JURY.

 

"Jury nullification of law," as it is sometimes called, is a traditional American right defended by the Founding Fathers. Those Patriots intended the jury to serve as one of the tests a law must pass before it assumes enough popular authority to be enforced. Thus the Constitution provides five separate tribunals with veto power representatives, senate, executive, judges and JURY that each enactment of law must pass before it gains the authority to punish those who choose to violate it. Thomas Jefferson said, "I consider trial by jury as the only anchor yet imagined by man, by whom a government can be held to the principles of its constitution."

 

Forchion's defense raises hackles in the legal establishment, but it's based on the time honored doctrine of "jury nullification." In its modern form, the right of jurors to refuse to enforce laws they see as unjust was established in 1670, during the trial in England of William Penn for preaching Quakerism then an illegal Religion. Penn had clearly broken the law, but the jury ignored the statute and the judge and acquitted Penn.

Today because of the War on Drugs, "Rastafari" is just as illegal as William Penn's Quakerism! Most citizens have no idea how the stupid "WAR ON DRUGS" has weakened the Bill of Rights.

The jurors were actually jailed for their votes, but refused to change the verdict, an appeals court then set them free.

 

Jury nullification followed an honorable path thereafter; helping to establish the principle of free speech in America during the 1735 trial of John Peter Zenger for seditious libel he'd criticized the colonial governor of New York in print. Like Penn, Zenger had clearly violated the law, but the jury set him free.

 

Later, jurors used their power to geld the Alien and Sedition Act which blatantly attacked free political speech and to render the Fugitive Slave Act unenforceable. No less a light than John Adams said, "It is not only [the juror's] right, but his duty to find the verdict according to his own best understanding, judgment, and conscience, though in direct opposition to the direction of the court." The first Chief Justice of the Supreme Court, John Jay, said that, "the jury has the right to judge both the law as well as the fact in controversy."

 

Modern judges and prosecutors aren’t as fond as the founders of the idea of juries taking their own lead in the courtroom. Judges don't seem to like surrendering that much power to common citizens, while prosecutors get hives whenever jurors look in disdain at one of the armory of statutory clubs used to bludgeon the public into submission. After all, what's the point of going to law school, passing the bar, scrambling for a plum spot as an Assistant District Attorney, and then running for the bench or the legislature if twelve randomly assembled plumbers, secretaries, and aluminum siding salesmen can blow a Bronx cheer at all your hard work? The fact of the matter is its legal and they try to keep if from the public. It's rare for a defendant to attempt to use this knowledge as a defense, but Mr. Forchion is in a unique situation as the first defendant charged until this new law.

Unlike juries of the past, modern juries are not usually advised that they're sitting in judgment of the law as much as in judgment of the defendant. In Mr. Forchion's proceedings Assistant Prosecutor John T. Wynne, argued to Judge Freeman (May 20, 1999-Motion Hearing), "That although Jury Nullification is a Constitutionally permissible function of the Jury, Mr. Forchion should not be allowed to argue this before a jury."

Nevertheless, knowledgeable defendants like Ed Forchion have continued to turn to their fellow citizens for a little common sense and mercy. While state and federal prosecutors try to prevent them from knowing about this other option.

 

Just as Prohibition era jurors flipped the bird to Elliott Ness and company, their counterparts today make marijuana busts in some parts of the country little more of a hassle than traffic tickets and that's what Forchion is counting on.

 

Even as the legal establishment has turned against jury nullification, it is now being touted in an organized manner by libertarians, drug legalization activists, gun owners, black activists and all sorts of leave-me-alone types, many of them working through the Fully Informed Jury Association. The coalition's tactic is simple: Get the word out so that potential jurors are familiar with nullification and willing and able to use it, if ever summoned to the trial of some victim of today's ban-it-if-it-moves, lock-it-up if-it's black, America.

 

The tactic seems to be working. For the past several years, prosecutors have complained that anti-government sentiment has produced hung juries and even outright dismissals in cases where the powers-that-be seem to be pursuing defendants as much for ideology as for actions.

According to a 1997 AP article:

 

Federal charges against homegrown terrorists - including racketeering, conspiracy, possession of weapons or explosives, or organizational criminal activity - result in dismissals, acquittals or mistrials more than 57 percent of the time, according to a study of 1980s cases by Brent Smith, a professor at the University of Alabama at Birmingham. As a comparison, U.S. attorneys reported victories in 87 percent of all federal prosecutions concluded in 1996.

 

Note that the majority of these "terrorism" cases involve nonviolent weapons or explosives possession, and allegations of plans that were never carried out. Most where conspiracy cases. It's not just political cases either. Early this year, The Washington Post reported:

For decades, a 5 percent hung jury rate was considered the norm, derived from a landmark study of the American jury by Harry Kalven Jr. and Hans Zeisel published 30 years ago. In recent years, however, that figure has doubled and quadrupled, depending on location.

 

Something is going on there. Something that ticks off prosecutors, but may be a very effective wake-up call to legislation-happy politicians. It's no fun to pass laws that can't pass a jury's laugh test.

Ed Forchion knows all of this, and he's been doing his best to reach as much of his likely jury pool as possible with press releases, op-ed pieces, and good, old-fashioned leafleting. The most masterful move Ed has done was his runs for political office, he ran for Camden County freeholder and NJ State assembly (8th Dist), in 1999 to keep his public profile as high as possible. In 1998 he ran for both Camden County Freeholder and the US Congress, again just to present himself to his potential juror's. The odds are pretty good. He only needs to convince one juror out of twelve in his big marijuana possession case to treat "not guilty" as if the words were chiseled in stone. The local press have been forced to report on Mr. Forchion, and his opinions are thus reaching his potential jurors all the while utilizing the equal access, and fair reporting rules of the Election laws.

 

Ras Ed, as Mr. Forchion is called amongst his followers is a rarity; he is a Fully Informed Defendant asking for a fully informed jury. Maybe a fully informed media will cover his JURY NULLIFICATION TRIAL.

 

Ed has announced plans to run again for the 1st District Congressional seat as his trial most likely will be also proceeding.

Let the jury decide

    Despite the guarantees of both the US CONSTITUTION , and the NEW JERSEY STATE CONSTITUTION'S of "freedom of religion".  I am now being victimized and persecuted by the State of New Jersey because of the Religion I follow. I am a follower of the African based RASTAFARI RELIGION . We as followers of Rastafari  regard the "god grown" herb (marijuana) which we call GANJA , as a "GOD" given holy sacrament in much the same way Christians and Catholic's regard the fruit "grape" which they process into wine, or PEYOTE which native Americans use similarly.

    The Democratic and Republican parties have abandoned the constitution, and it's protections in favor of its own self serving/enriching policies. Their policy of "WAR" against my religious sacrament has essentially turned my religion into an illegal religion, again despite the constitutional guarantees of freedom of religion that this country was built on. The beliefs and practice's of my religion incorporate the use of ganja (marijuana), the marijuana laws infringe upon my right to "freely exercise" my chosen religion. This is why I openly advocate   JURY NULLIFICATION as a way of correcting this problem. A Jury should be read the NJ & US constitutions and come to the obvious conclusion. That the Marijuana laws violate my "gods" laws and are in violation of man's law, they are unconstitutional! 

     I want my jury to be allowed to listen to everything I've got to say, then Judge the law as well as the evidence. Asst Prosecutor John T. Wynn argued before Judge Freeman (May 24th, 1999) that although, "jury nullification was a constitutionally acceptable function of the jury Mr. Forchion should not be allowed to argue this to his jury". 

Question: What's he afraid of, "I'm the one facing 30 years!”                                  "                                                            
Answer: The Truth! A fully informed Jury may recognize the unjustness of this law! And acquit!

CAMDEN - The highly unusual drug case involving marijuana-legalization advocate Edward Forchion came to a conclusion yesterday as he was sentenced to prison for his part in brokering a drug deal for his brother.

With Forchion's wife, Janice, and two of his young children in the courtroom, Camden County Superior Court Judge Stephen W. Thompson sentenced Forchion to a 10-year prison term.

Forchion will be eligible for parole in slightly less than two years, and he could apply for intensive supervisory parole in six months.

"I don't smoke marijuana," Janice Forchion said after the trial. "But I don't understand why they let murderers, rapists and pedophiles off so quickly and put away marijuana smokers."

If Forchion, of Browns Mills, pursues the supervisory parole option, he could be tested at any time under the program.

Forchion - who has been cited for lighting marijuana joints in the chambers of the New Jersey Legislature and the office of U.S. Rep. Rob Andrews (D., N.J.) - says he remains an unapologetic marijuana smoker.

A Rastafarian, Forchion has said he smokes marijuana for religious reasons, to relieve physical ailments, and to soothe chronic depression. Since the mid-1990s, Forchion, a former cross-country truck driver, has been an outspoken advocate of legalizing marijuana.

In November, he ran unsuccessfully for the Burlington County Board of Chosen Freeholders and a U.S. House seat under the Legalize Marijuana Party.

Assistant Prosecutor John Wynne Jr. said the Prosecutor's Office would not contest Forchion's application for the parole.

When he entered a guilty plea in September, Forchion acknowledged that he introduced his brother, Russell, to a marijuana supplier in Arizona and had flown to Tucson on behalf of his brother in October 1997 to seal the sale of about 40 pounds of marijuana.

The shipment was delivered to the Bellmawr Industrial Park by Federal Express.

Shortly after picking up the marijuana, Russell Forchion was arrested as he drove away from the park, authorities said. Edward Forchion, who was driving behind him, was also arrested.

A third man, Eric Poole, who signed for the package, was convicted of a lesser crime. Russell Forchion testified for the prosecution, and served about five months in prison before being placed on intensive supervisory parole.

In his September trial, Edward Forchion served as his own attorney. In his opening statement, he criticized what he said were unjust marijuana laws and asked jurors to invoke jury nullification, in which a jury can set aside the law it believes that the law is unjust. Jury nullification cannot be advertised to a jury under New Jersey law, but Wynne did not object during the proceeding.

The trial ended when Wynne offered Forchion what both said was a good deal - potentially spending as little as six months in prison.

But before the sentencing yesterday, the judge heard a motion from Forchion to withdraw his guilty plea. Forchion said that he did not get a proper trial, because the Public Defender's Office refused to pay for expert witnesses to testify on his behalf. He said he wanted a new trial.

Wynne successfully countered that if Forchion were given a new trial, the first trial would have been essentially a practice run, something that every attorney would like but that collides with the integrity of the system.

The judge denied Forchion's motion to withdraw.

"In the middle of the trial, you elected to plead guilty, sir," Thompson said.

Forchion said that he pondered not showing up in court yesterday. Last week, he called news organizations in South Jersey to say he had fled to Canada and was seeking asylum at the Cuban Embassy there. (see: asylum request )

By Wednesday, he sent e-mails to the media that he would appear for his sentencing.

"I didn't want [my wife] to lose the house," said Forchion, referring to the home she put up to post his $65,000 bail.

Thompson said he believed Forchion was sincere in his advocacy for reform of marijuana laws. But he noted that Forchion did break the law.

"Your beliefs at this juncture are misguided," Thompson said.

Ed "NJWeedman" Forchion is no longer smoking pot.

Comparatively speaking, this is similar in scope to a magic genie no longer granting wishes.

Forchion, 37, was released last week from state prison, where he served 17 months for possessing 25 pounds of marijuana.

He was released into the state's Intensive Supervision Program (ISP), a heightened form of parole, in which Forchion, among other things, could have his body and home searched for any illegal herbs.

"Obviously, I can't smoke marijuana," Forchion said. "But that won't be a problem. I told the judge I went 17 months on the inside without smoking, and I was offered pot every day. Every day. I was a mini-celebrity in there."

The reason for Forchion's celebrity is due to his unflinching belief that marijuana should be legalized.

Known nationwide, Forchion, a Pemberton resident, has pulled many stunts to bring attention to the legalization movement.

He's run for office, getting 2,706 votes for Burlington County freeholder and 1,983 votes during a congressional run.

He also has lit up joints in courtrooms, a judge's office, and most famously, during a session of the state assembly.

But that's all behind him, thanks to the conviction and the conditions of the ISP release.

"Because of ISP, I can't be an open advocate for legalization," Forchion said. "But none of my opinions have changed. And people know me more now than before, so I don't need to run around with a sign or smoke in the assembly."

While Forchion might be keeping his legalization talk on the back burner, he is still intent on fighting the system that put him in prison in the first place.

Forchion is fighting the battle on many fronts, most notably in Federal Appeals court.

The court accepted his appeal, and Forchion is now waiting for his day in court.

Forchion alleges his trial was unconstitutional due to his not being allowed to call witnesses and his not being allowed to pursue jury nullification as a defense.

Jury nullification, in it's pure sense, is when a jury decides that a law is unjust, and thus refuses to convict.

The trick to this strategy, however, is that it is illegal in Jersey to inform a jury of this right.

Forchion went with the strategy anyway, without help from the Public Defender's office.

And Forchion was not allowed to call witnesses, including doctors, who were set to testify marijuana should be legal.

"What happened was a total sham and mockery," Forchion said. "People just blew me off because I was a pothead. I was the little guy fighting the Goliath of government and they took away my slingshot -- jury nullification. It's the 'We the People' weapon."

While in Riverfront State Prison, Forchion also had trouble securing all the court transcripts needed for his appeal.

After 17 months, he says he now finally has them all.

"I couldn't believe state officials got away with not giving me my transcripts," Forchion said. "It was a cover-up."

One question that hangs over Forchion's head, especially now that he out of jail, is what happens if the federal courts overturn his original conviction? Would he be willing to go back on trial, call his witnesses, practice jury nullification, and risk being sent back to jail? All in the hopes of legalizing marijuana?

"Absolutely," Forchion said.

Political candidate and outspoken marijuana legalization proponent Ed “NJWeedman” Forchion is under arrest again in New Jersey. He was picked up by police at his weekly parole meeting and booked into the Burlington County Jail sometime between 3 and 11 PM on Monday, August 19, 2002. Apparently the arrest was for violating his parole agreements by filming a series of pro-marijuana and First Amendment commercials. Under the terms of his parole, Forchion is not allowed to publicly discuss marijuana in any way. Ironically, the commercials, which had been slated to run in four counties in New Jersey on the Comcast Cable Company, were barred by Comcast management before they aired. 

At this time details about his charges are still a bit sketchy, as the Burlington County jail refuses to divulge any information about the case other than that he is in the jail, alleging that they are not allowed to "release any information to civilians.” (The Burlington Co. jail later amended this statement, telling Drugwar.com that we were entitled to have this information, but only from the warden, who has not returned repeated calls.)

Forchion has a long history of fighting for the right to use marijuana, and of paying the consequences for battling prohibition. He’d had a couple of minor brushes with the law over petty offenses in his early years (but compared to many of the corporate crooks still sitting pretty without seeing the inside of a jail cell, he’s an angel of propriety). In November of 1997, having built up a thriving marijuana smuggling business while working as a truck driver driving his own rig, he was arrested in a sting operation as he and his brother were trying to pick up a FedEx package containing 40 pounds of marijuana. This lead to both brothers, along with a third friend, being the first people tried in New Jersey under the then-new Omnibus Crime Act, which allows for anyone convicted of trafficking over 20 pounds of pot, even their first offence, to do 20 years in prison. 

While awaiting trial, Forchion undertook a campaign to bring marijuana reform into the public consciousness, as well as the right to Jury Nullification (which is illegal in New Jersey) running unsuccessfully for office in the US congress and for the office of Burlington County Freeholder, as the sole member of the Legalize Marijuana Party. Forchion also undertook civil disobedience, lighting up joints in the New Jersey State Assembly and at the Liberty Bell, among a dozen or so very public places. Two years, 15 hearings, and three judges later, Forchion accepted a plea bargain of 6 months in jail and 27 months in New Jersey’s Intensive Supervised Parole program, after refusing to rat out his marijuana connections. Reporting to the Riverfront Prison in Camden, NJ, on Jan. 12, 2001, (where prison guards immediately found 10 joints secreted within the sole of his sneaker), Forchion was informed he was not yet eligible for ISP, due to his “extensive” criminal history. He did 15 months inside before finally getting released on April 3, 2002 into ISP. He almost immediately filed an appeal of his sentence, which if he looses he faces up to 20 years in prison.

“I'm still fighting this conviction,” Forchion wrote Drugwar.com in an email a few hours before his arrest Monday. “My parole officer (Tom Bartlett) also ordered me not to talk to the press. Which I regarded as a illegal order. Because I knew such a order not to talk to the press was illegal I gave a few interviews anyway. On May 27th, I stood outside the Burlington County Courthouse and protested my not being able to see my daughter because of the Religion [Rastafari] I have chosen. I passed out fliers and was interviewed by the Burlington County Times and the Trentonian.” On the following day he was placed under house arrest, then was arrested on June 6 and sat in jail for four days for speaking to the newspapers.

“I was livid,” writes Forchion, “this was totally un-American. So I contacted Peter Christopher of http://www.nextplayvideo.com/ (Activist video) and asked him if he could help me by making a couple of First Amendment commercials for me. He did, we made three. I went to Comcast here in Mt Laurel, NJ, and presented them. They (Comcast NJ) accepted them, had me sign a contract and I gave them a deposit. The office manager actually liked them.”

“In our standard advertising contract, there is a paragraph that prohibits habit forming drugs and illegal products from appearing in advertising spots. so it is a cut and dried situation for the company,” said David Shane, Comcast's vice-president of corporate communications. “The spots clearly violate the agreement that he signed, so as a result we returned his $100 deposit, and the company is not running the spots.” 

When it was noted that Comcast takes money from, and airs commercials by both the Office of National Drug Control Policy’s National Anti-Drug Media Campaign, and the Partnership for a Drug-Free America, Shane said, “They don’t promote the use of habit forming drugs or drug paraphernalia. Let me read you the contract, the clause in the contract. ‘The following material is explicitly prohibited. Drugs/illegal products, including habit forming drugs, drug paraphernalia, or establishments that promote these products. Also included is advertising for a product of service which is illegal or has no legitimate use in the country, state, or municipality where systems franchise area [sic] are located.' So it’s pretty clear these spots violate that portion of the contract.” 

Although it is clear that marijuana has many different legitimate uses despite the US prohibitionist rhetoric and laws to the contrary, and may or may not be habit forming for some people, Shane stuck to his guns, but did not mention whether or not pharmaceutical companies which market habit forming drugs on Comcast have to abide by this same agreement. He did note that “Anybody who advertises on Comcast signs this standard advertising contract. Again, anything promoting the use of habit forming drugs or drug paraphernalia are prohibited on Comcast.” 

“I’m so fucking mad I could spit,” Peter Christopher told Drugwar.com when contacted about Comcast‘s decision and Forchion’s subsequent arrest. “We’re trying to get activists to do stuff like this. Sponsor some public access, shoot their own video. It took about 4 hours one afternoon at Ed’s house. I’m almost embarrassed to tell you how quickly I edited them. We wrote them for 30 seconds slots, timed them, and tried them. Actually the commercials were written and edited by a friend of mine. We’re trying to influence people to come out and work with us. I think they will.” Christopher points out how the system has really gone after Forchion, because he represents the counter-culture, he is very loud about his beliefs, and is not afraid of the repercussions that have resulted for standing up for what he believes is right. 

“These things go unchallenged every day,” says Christopher. “Guys get tossed around, nobody does anything about it. Why? I think a lot of it is fear. I’m going to tell you this, and you think about it. It may have never occurred to you. The problem is the system has turned too many people. Four out of five people tell them everything they want to know. How can you go from that situation to being an activist? How can you look other people in the face and help them change the laws when you’ve told on them? Eighty percent of the people arrested tell all. Those are the statistics, they don’t lie.” But Forchion himself refused to roll over and tell all.

On Monday night, Forchion reported for his weekly parole meeting. At the end, everyone was told they could go except Forchion, according to Christopher, who spoke at length with Forchion later that night. Forchion was taken into custody, during which his new commercials were mentioned as the reason his parole was being violated, then taken to the Burlington County jail where he now sits.

Forchion does not yet have a lawyer assisting him. He is also seeking help in obtaining enough money to run the commercials in any venue he can get them on. 

“The War on Drugs is being fought by two sides, the Government side and the winning side,” Forchion points out. “Apparently Comcast only wants the government side’s opinions expressed. This is absolute censorship. Yes, I had a shirt on with a "weed-leaf". Comcast airs far worst! They aired my campaign commercials three years ago and in those I had a bong and a fake weed leaves hanging out my suit jacket pocket. It wasn't the shirt, it was the words they didn't like. I was questioning the War on Drugs and what it is doing to the principals of freedom this country was founded on. This is an example."

A federal court judge yesterday ordered the "New Jersey Weedman" be freed from jail and returned to the early release program from which he was booted last year for advocating changes in the state's marijuana laws. 

U.S. District Court Judge Joseph Irenas, sitting in Camden, granted a temporary injunction sought by Ed Forchion, also known as the New Jersey Weedman, a self-styled marijuana activist. 
 
John Vincent Saykanic, a lawyer representing Forchion, said efforts were under way to get Forchion out of jail and home to his family. 

"Ed Forchion is a true freedom fighter," Saykanic said. "He has been fighting for what he believes in." 

Edward Barocas, legal director of the New Jersey chapter of the American Civil Liberties Union, said he was "extremely pleased" with Irenas' decision. 

"It makes clear to state officials that they cannot retaliate against a person under their control or supervision simply because they don't like the position he is advocating," Barocas said. 

Forchion had entered the Intensive Supervised Parole program last April after serving 16 months of a 10-year sentence for possession of marijuana with intent to distribute. He was kicked out of the program last August for, among other things, advocating the legalization of marijuana. 

In his ruling, Irenas said it was clear that the conduct that led to Forchion's being kicked out of the ISP program and returned to jail is constitutionally protected. 

"Most of the infractions cited by the ISP officers involved (Forchion) either speaking to the press, protesting and handing out pamphlets outside of the courthouse, running a Web site, or producing and appearing in television commercials," Irenas wrote. "This behavior is clearly protected by the First Amendment, particularly since it primarily involved (Forchion's) belief that marijuana should be legalized." 

Irenas ordered that the ISP supervising officers be forbidden from removing Forchion from the program for any future violations unless they first give him 48 hours notice of their intentions. If there is possible immediate harm to the public good if Forchion is not removed from the ISP program, the ISP officers can make an emergency motion before Irenas. 

Irenas also ordered that Forchion cannot promote the illegal use of marijuana once he is released. 

Forchion was returned to jail in August after allegedly violating terms of his admission into the program by advocating the legalization of marijuana when he allegedly filmed several public service announcements -- which never aired -- favoring changes in the state's drug laws. 

Forchion of Pemberton Township, Burlington County, pleaded guilty in September 2000 after he was charged with helping his brother and another person pick up 40 pounds of marijuana that had been shipped via Federal Express to Camden County in November 1997.
